Port Authorities
A port, with its interface function between land and water, offers an extensive and assorted palette of activities and services such as:
- Managing waterways, canals, locks, bridges, dams etc.;
- Managing the port’s infrastructure, roads and services such as illumination, electricity etc.;
- Delivering and maintaining buoys and other appliances for navigational purposes;
- Safety (ISPS, police- and surveillance service, emergency services, fire-brigade etc.);
- Dredging;
- Pilots;
- Consultancy/Advice to other port companies;
Goods must find their safe passing through the port area and be stored or kept in a safe and sound manner, without causing a risk for mankind, animals or the environment.
Sufficient control- and verification possibilities must be provided for the immigration- and customs authorities and for health departments and a safe infrastructure needs to be provided to allow all the aforementioned.
For both the "Landlord Port Authority" and the "operational Port Authority", Post and Co has developed comprehensive liability programs, covering the Port Authorities' legal and contractual liabilities in respect of e.g.
- Defence cover in case of damage to or loss of the Port Auhorities' properties, causing unsafe
infrastructures (for example a collision or sinking of a vessel, causing the waterway to get blocked)
- The Port Authorities' own or their subcontractor's acts or negligence
- Liability for the consequences of intentional deeds: negligence or gross fault and negligence of
employees or subcontractors
- Liabilities towards third parties
